Utah DUI Law

Utah law prohibits a person from operating or being in actual physical control of a vehicle while intoxicated. The law establishes three ways the state can establish intoxication: 1) the person has a blood or breath alcohol content (BAC) of .08 grams or greater; 2) the person has sufficient alcohol in his or her body so that a subsequent chemical test shows a BAC of .08 grams or greater at the time of the test; or 3) the person is under the influence of alcohol, drugs, or a combination of those to a degree that make s the person unable to operate the vehicle safely.

The Utah Supreme Court has interpreted “actual physical control” as a low standard. Courts have found a person was in actual physical control because he was intoxicated while in the driver’s seat with possession of the ignition key and the ability to start the vehicle and move It, even though the vehicle was blocked by a fence in front and another vehicle in the rear. Actual physical control doesn’t require the key to be in the ignition or the engine to be running. Court’s have even found actual physical control where the defendant was unconscious.
